PPPS. Due to the constant remarking by commentor theism, I have removed the first image from display on my blog. The first image used to be one that is clearly watermarked.

I admit and give full credit to theism for making me doubt if my use of the watermarked image is perfectly permissible under Fair Use Doctrine (although I suppose I could have just trash-talked the news agency for not condemning the Palestinian terrorist enough, and that would count as ‘criticism’).

However, he did not provide me any information or link that abrogates my Fair Use of the photo – so if I have a change of heart or come across a clear vindication of my Fair Use, it’s back to the watermarked image again… If anyone has a clear resolution to this, do comment below.

I also apologize to the owner and photographer of that image, IF I had contravened the law even under Fair Use Doctrine.

PPPPS. Heart has been changed, using the image again, dear Hamas GO TO HELL.

If you want to get ANP to sue me (good luck getting them to reply your emails) the way AP is bullying SnappedShot, they are welcome to claim 110% of my earnings from this blog.

    2) the nature of the copyrighted work – Photograph meant to illustrate the dangerous situation in Palestine disseminated throughout the world and cyberspace, now including my blog.

    3) amount and substantiality of the portion used in relation to the copyrighted work as a whole – I include the original caption, credits and site of the copyright owner.

    4) the effect of the use upon the potential market for or value of the copyrighted work – ANP and Ali Ali are unlikely to lose any business from this photo appearing here.

    I’m not being petty. I’m a photographer myself, and had you stolen one of my images, you’d be defending yourself in court. Somebody worked very hard for years to be in a position to record that photograph, and put him or her -self at considerable risk. Your Quixotic rant aside, you should respect the man’s worth.

    Whether you profit financially from using this person’s image or not is legally and morally beside the point. The copyright mark clearly indicates the nature of the photo, and that it’s not available to Joe Sixpack for his blog. I don’t want AMP to sue you; that’s beside the point. Nor do I call the police every time a child shoplifts batteries and candy.

    But I’m appalled at your moral standards.

    I’m calling you out on that one. I insinuate that you are not genuinely at all appalled at my moral standards, but only say so as part of an effort to discredit me in any way you can – having failed to do so on my incest post.

    I did not simply take the image alone and reproduce it here. I included the full credit to the photographer and the news agency in the image on my blog itself, and in no way reduce their income or marketability. In fact, by reproducing the photo with the credits, I am providing free publicity for their names.

    So your appalledness aside, I feel no guilt in what I do.

    Put simply, I disagree with you that I have stolen anything. I contend that my reproduction of the images is permissible under Fair Use Doctrine, and will only admit wrong if you cite me specific legalities that contravene my nonprofit use of the images under Fair Use Doctrine (which does not exist in a form that applies to motor vehicle use, so your comparison is faulty).

    If I am convinced that I am in the wrong, I will remove the image, apologize to you and the owners onmy blog, and give full credit to you for pointing out the illegality of my copyright theft.

    Yeah, Hutch, I remember the photo of an UN 4WD that was still very much intact after being allegedly hit by a Hellfire missile from an Israeli helicopter! Not to mention that of a Baalestinian ambulance with a clean round hole on its rather rusty roof made by another similar missile allegedly!

    The Hellfire missile is a 100 pound anti-tank missile and its warhead should be equivalent to that of a 105mm artillery shell….yet it can’t even demolish those everyday thin skin vehicles?!

    The fair use exemption to copyright law applies to criticism *of the work you’re using*. It DOES NOT apply to taking somebody’s work for unrelated purposes. You’ve used a photograph a person took and then clearly marked as copyrighted, and using it to make racial statements that have nothing to do with the photo itself.

    You stole use of a photograph, then became highly belligerent when this was pointed out to you. You’ve twisted coming up with excuses, one as bad as the next. We can both tell none of the excuses you came up with apply.

    You’re an unrepentant sinner, as your actions have made clear.

    Publishing mp3 songs on a file server help rich corporations. You’ve stolen from an individual, working photographer, who watermarked his work to avoid people like you taking it.

    Please, spare me the moralizing. You’re not a 503-C, so don’t throw words like “non-profit” around. Don’t invoke laws that don’t apply to you and then claim ignorance with cute phrases like “if you cite me specific legalities.” Ignorance of the law is not excuse under law. And, as I’ve already said, I’m offended by your arrogant lack of a moral compass, more than the flagrant legal violation. Still, go read the law yourself.

    It’s easy ( as you’ve shown ) to beat your chest like an ape, mention legal concepts that don’t apply to your behavior, and, ultimately, say “so this is only a little immoral of me.” Following the moral code you claim to believe in is obviously a lot more difficult for you.

    I disagree with the current trend in academic circles stating that Zionist philosophy is racist and discriminatory.

    It could not be further from the truth!

    The textbook definition of Zionism is “the national movement for the return of the Jewish people to their homeland and the resumption of Jewish sovereignty in the Land of Israel, advocated, from its inception, tangible as well as spiritual aims.” It is an ideology based on thousands of years of persecution and has only been able to become reality in the past century.

    Zionism calls for Jews to live in the land of Israel. It does not call for non-Jews to get out. It does not prevent non-Jews from living there. Only misguided statements made in the name of Zionism could possibly be regarded as discriminatory, such as statements that only Jews belong in Israel. Although such statements have been made by extreme elements in the Jewish religion, we all know that there are extremists in every religion and political group, and similar to other religions or political groups, they do not represent the view of the majority.

    I am increasingly worried about public opinion regarding Zionism, and some people I have met mistakenly believe it has to do with Israel’s policy in the Palestinian Territories (which is based on very real security threats and not ideological yearnings – furthermore, they fail to take into account the daily terrorist attacks against Jewish Israelis, both civilians and soldiers, in the territories which make this policy a necessity for survival). These misinformed people talk derogatively about Zionism but actually have no idea what it is truly about, namely establishing a place where Jews can be Jewish and never feel or be threatened for it.

    If Israel has no right to exist, then there is greater reason for Pakistan to be obliterated.
